TERMS AND CONDITIONS OF USE OF THE WEBSITE

  1. General Information

    The purpose of these general terms and conditions of use of the website https://genesis.com/fr/en/ (hereinafter referred to as the “Terms and Conditions”) is to set out the terms and conditions under which

    1) On the one hand, Hyundai Motor France, a simplified joint-stock company with a share capital of €7,349,627.00, registered with the Nanterre Trade and Companies Register under number 411 394 893 and with its registered office at TOUR NOVA – 71 Boulevard National, 92250 La Garenne-Colombes, intra-Community VAT number FR 50 411 394 893 and operating its Genesis-related business under the trade name “Genesis Motor France” (hereinafter referred to as “Genesis Motor France”) makes available to its users, whether natural or legal persons (hereinafter referred to as the “User ”) the website https://genesis.com/fr/en/ and the services available on said website, including, but not limited to :

    - Discovering the Genesis brand and its vehicle models
    - Contacting Genesis Customer Service
    - Vehicle configuration
    - Booking a test drive

    2) On the other hand, the way the User accesses the website and uses the services described above

    Access to and use of the Website is subject to Users’ compliance with the Terms and Conditions. Consequently, mere access to the Genesis website at the following URL https://genesis.com/fr/en/ (hereinafter referred to as the “Website”) implies acceptance of the Terms and Conditions as well as all applicable laws in force.

  2. Amendments to the Terms and Conditions

    In order to better serve its Users, the Website is constantly evolving. Consequently, Genesis Motor France or any other third-party service provider reserves the right to amend and/or update, at any time and without prior notice, access to the Website, the terms of the Terms and Conditions, as well as the content, products and/or services presented on the Website and any associated documents, without this giving rise to any liability on its part, that of the members of its network, or that of its employees.

    Such modifications are binding on Users by virtue of their mere use of the Website, without any prior notice being required from Genesis Motor France.

    Any information, photographs or illustrations appearing on the Website are provided for information purposes only.

    The information presented on the Website has no contractual value and does not in any way constitute an offer to sell vehicles or services, whether by Genesis Motor France, its authorised Genesis dealers and repairers, or any other affiliated company.

    The purpose of the Website is to present the Genesis brand’s world, products and services distributed in France by Genesis Motor France.

    No information appearing on the Website shall replace the information provided by an authorised Genesis Dealer or Repairer, particularly with regard to vehicle specifications, availability, services offered or applicable terms and conditions.

    Genesis Motor France disclaims any liability with respect to the accuracy, completeness or updating of the information on the Website.

  5. Use of the Website

    When using the Website, the User undertakes not to carry out any actions likely to cause computer, functional or any other type of failure that could affect the operation of the Website or any service accessible via the Website.

    The User shall comply with all applicable national and international regulations, as well as the rights of third parties, and shall refrain from causing harm to Genesis Motor France and/or third parties in any way whatsoever.

    The User acknowledges that they are fully responsible for their use of the Website, and for any direct and/or indirect, as well as material and/or immaterial, consequences that may result therefrom.

  6. Product information

    The purpose of the Website is to provide Users with a general presentation of the range of products and services offered by Genesis Motor France. As such, it contains information relating to Genesis-branded products as well as promotional activities marketed in France under the trade name Genesis Motor France.

    The models and/or versions presented on the Website, together with their equipment, options and accessories, are those distributed in mainland France. As such, they may vary from one country to another or may not be available in all countries worldwide. The equipment presented may be standard or optional depending on the version.

    With a view to the continuous improvement of our products, equipment, options, colours and technical specifications may be modified at any time. Accordingly, the information provided is based on the technical specifications applicable at the time of publication online or at the time of updates to the Website pages.

    The Genesis products described on the Website are presented exclusively for sale by authorized Genesis Dealers and/or Repairers. Therefore, in order to obtain precise and up-to-date information, in particular regarding availability, features, content and variants (standard equipment, optional equipment or accessories, specific service conditions applicable to certain models, powertrains, trim levels, etc.) of Genesis vehicles, Users are advised to contact an authorized Genesis Dealer and/or Repairer.

  7. Fuel consumption values

    The fuel consumption values of approved passenger vehicles sold in France, expressed in litres per 100 kilometres, are measured by accredited laboratories in order to allow an objective assessment of the standard fuel consumption of the various models. These measurements, conducted on a rolling road test bench in accordance with a standardised European procedure, correspond to a so-called “combined cycle”. Accordingly, the standard fuel consumption is a theoretical value.

    Actual fuel consumption may vary depending on driving style and numerous other factors, such as road conditions, traffic conditions, type of powertrain, vehicle condition, tyre pressure, weather conditions, vehicle load, etc.

  8. Intellectual property rights

    The presentation and content of this Website are fully protected by the laws and regulations relating to the protection of intellectual and industrial property rights.
    8.1 Intellectual and industrial property

    In accordance with Articles L.111-1 et seq. of the French Intellectual Property Code, Hyundai Motor France holds the intellectual property rights to the Website, which constitutes a work of authorship.

    The photographs, texts, slogans, drawings, images, animated sequences (with or without sound), as well as any works incorporated into the Website, are the exclusive property of Hyundai Motor France or of third parties who have authorised Hyundai Motor France to use them.

    The vehicle models displayed on the Website are protected under copyright law and under Articles L.511-1 et seq. of the French Intellectual Property Code relating to the protection of designs and models.

    Reproductions by the User, on any medium whatsoever, of the Website and/or of the works reproduced therein are authorised, provided that such reproductions are strictly and exclusively reserved for personal use, excluding any use for advertising and/or commercial and/or informational purposes, and that they comply with the provisions of Article L.122-5 of the French Intellectual Property Code.

    It is hereby recalled, in accordance with Articles L.335-2 and L.521-4 of the French Intellectual Property Code, that, except as provided above, any reproduction, representation, use or modification, by any process whatsoever and on any medium whatsoever, of all or part of the Website, of all or part of the works composing it, and/or of the vehicle models featured therein, without the prior authorisation of Hyundai Motor France, is strictly prohibited and constitutes an offence of infringement punishable by up to three (3) years’ imprisonment and a fine of up to 300,000 euros.

    8.2 Trademark law

    The Genesis trademark, together with all associated logos, trademarks and distinctive signs, are registered trademarks, depending on the territory, of Hyundai Motor Company, Genesis Motor Europe GmbH and/or Hyundai Motor France, and are used in France by these entities in the course of their respective business activities.

    Any reproduction, imitation and/or use of these trademarks without the prior written authorisation of their respective owner (in particular Hyundai Motor Company, Genesis Motor Europe GmbH and/or Hyundai Motor France) constitutes a criminal offence. It is prohibited to use, permanently download, reproduce or disseminate them in any manner whatsoever without the prior written authorisation of their respective owner.

    Other trademarks are also referenced: they are generally identified by the use of capital letters. They are used by Hyundai Motor France either with the authorisation of their respective owner or as a simple indication of products or services offered by authorized Genesis Dealers and/or Repairers approved by Hyundai Motor France. In accordance with Article L.716-10 of the French Intellectual Property Code, it is hereby recalled that the reproduction, imitation or use of such trademarks without the prior authorisation of their respective owner constitutes an offence of infringement punishable by three (3) years’ imprisonment and a fine of 300,000 euros. 

  9. Personal data

    Hyundai Motor France processes Users’ personal data in connection with their consultation of the Website.

    Use of the Website is subject to the “Privacy Policy”, available at the following URL: https://genesis.com/fr/en/footer/privacy-policy/. 

  10. Consumer's right to object to cold calling

    In accordance with French Law n°2014-344 of 17 March 2014 relating to consumer protection, any consumer may register free of charge on the Bloctel register, which is the opt-out list for cold calling, in order to no longer receive marketing calls from professionals with whom they do not have an ongoing contractual relationship.

  11. Hyperlinks

    The Website may contain hyperlinks to other websites that are entirely independent of the Website. Genesis Motor France does not in any way assume or guarantee that the information contained in such hyperlinks or in any other website is accurate, complete or reliable. Accordingly, any access to another website linked to the Website is undertaken at the User’s sole and full responsibility.

    Similarly, Genesis Motor France shall under no circumstances be held liable for the content, or for the products and/or services offered on websites to which the Website may be linked through hyperlinks or any other type of link redirecting to the Website.

    The creation of a hyperlink to the Website requires the prior written authorisation of Genesis Motor France. Failing this, such action would constitute an infringement of Genesis Motor France’s intellectual property rights, which may be subject to the applicable provisions of the French Intellectual Property Code.

  12. Liability

    The User uses the Website at their sole and entire responsibility. Under no circumstances shall Genesis Motor France be held liable for any direct or indirect damages resulting from access to or use of the Website, its content, any websites to which it links, or any websites linking to the Website.

    The User undertakes not to perform any action likely to cause malfunctions, whether technical, functional or of any kind, that could affect the operation of the Website or of any service accessible through the Website.

    The use of the Website is provided without any warranty whatsoever. Accordingly, the User acknowledges that Genesis Motor France provides no warranty of any kind in relation to the use of the Website. In particular, no warranty is given as to the availability of the Website, or as to the reliability, accuracy, timeliness or completeness of the content, information and various features available on the Website, except for any content of a contractual nature. Consequently, and without limitation, Genesis Motor France shall not incur any liability in the event of modification, suspension and/or interruption of the Website. It is expressly stated that such events shall not give rise to any compensation from Genesis Motor France.

  13. Mediation and disputes 

    Dispute with an authorized Genesis Dealer and/or Repairer

    In accordance with Article L.612-1 of the French Consumer Code, a customer may refer the matter free of charge to the competent consumer mediator if they have attempted, unsuccessfully, to resolve a dispute amicably with an authorized Genesis Dealer and/or Repairer.

    Accordingly, the customer may submit a written complaint to the mediator designated by their seller, after obtaining the relevant details directly from them. Depending on the case, the mediator appointed by the seller shall be:

    The opinion issued by the mediator is not binding and is not enforceable upon the parties.

    If the dispute persists, the User is informed of the possibility of referring the matter in writing to the mediator designated by Genesis Motor France, namely CMFM, either online via the website www.mediationcmfm.eu or by post to the following address:  Médiation Cmfm - 19 Avenue d’Italie - 75013 Paris.

  14. Applicable law

    The Website and the Terms and Conditions shall be governed by French law. Any dispute arising out of or in connection with the Website and/or the Terms and Conditions shall be subject to the jurisdiction of the competent French courts.

    It is understood that the present provisions shall not derogate from any mandatory statutory provisions.
