Genesis and Your Privacy
Genesis Motor Netherlands is a trade name of Hyundai Motor Netherlands B.V.
In this privacy statement, Hyundai Motor Netherlands B.V. ("Genesis" or "we"/"us") explains how personal data is handled from customers, potential customers, drivers of Genesis vehicles, and other persons with whom Genesis Motor Netherlands contracts or has contact (such as buyers, suppliers). Personal data refers to information that can reasonably be traced back to an individual.
How We Obtain Personal Data
We collect personal data partly because you provide it to us yourself, for example when applying for financing, requesting a brochure or other information, entering into an agreement with us, or using our website and allowing us to record data about your interests and preferences. If you do not provide data that is mandatory (as applicable in certain cases), the consequence may be that we cannot fulfill certain contractual obligations. Some products and/or services are offered by our partners, and sometimes there are references to websites of such partners or other third parties. This is clearly indicated. How such parties handle your personal data is explained in their privacy statements.
Additionally, we receive personal data from third parties, such as our dealers and service partners when you provide your data to them, for example because you are a customer or interested in a product or service of (one of) these parties, or because you leave data with them that they provide to us. We then process your contact details (name, address, city, email address), date of birth, gender, customer numbers, contact and marketing preferences, vehicle data (including your vehicle identification number (VIN), registration number, model, year of manufacture, and mileage), and other information about your preferences related to the product or service you have purchased.
Legal Grounds
We may use personal data based on six different legal grounds mentioned in the law:
- your consent;
- the necessity to use personal data for the performance of one or more agreements to which you are a party, or to take measures at your request before entering into the agreement;
- to safeguard our legitimate interests or those of the organization with which we share your personal data;
- to comply with a legal obligation;
- to protect vital interests of the data subject; and
- the necessity to process personal data for the performance of a task carried out in the public interest.
Legitimate Interests
Legitimate interests of Genesis or a third party include marketing, advertising, communication, determining which information, products, and services you are likely most interested in, IT management and security, research and analysis of own products or services, business administration, legal affairs, internal management, sharing with affiliated parties such as Hyundai Motor Europe and Hyundai Motor Company.
Purposes and Legal Grounds for Processing Personal Data
We process your personal data for specific purposes described below:
- to respond to requests (e.g., requesting a quote, booking a test drive, applying for credit or a lease proposal, or sending brochures);
- in the context of a purchase, credit, lease, or service agreement you enter into with a dealer, service partner, or affiliated company;
- handling, administration, and invoicing of orders, for the execution of an agreement or due to legitimate interests;
- offering, organizing, and completing competitions and promotions, based on legitimate interests or because you enter into an agreement for this;
- providing customer service, including service around purchasing services and/or products and handling complaints and requests, based on an agreement you are party to, legal obligations, and/or our legitimate interests;
- sending surveys, research, and marketing and service messages via email, phone, post, social media, and/or other channels. You always have the option to unsubscribe from direct marketing by objecting or withdrawing your consent if you have given it;
- conducting market research to improve our business operations, brands, services, and products and to map customer wishes, based on legitimate interests;
- improving our communication by tailoring it to your personal preferences, based on our legitimate interests;
- combining data obtained through our websites via cookies (or similar technologies) with other customer data to create a customer profile of you, based on your consent;
- executing or coordinating possible recalls, based on legitimate interests or legal obligations;
- for advertising and marketing purposes, including targeted ads via platforms such as Facebook and analyzing the development of advertising and marketing activities, based on our legitimate interests, and where required, based on your consent;
- analyzing your browsing behavior through cookies or similar techniques, where required with your consent and otherwise based on our legitimate interests.
Sharing with Third Parties
Your personal data is shared with:
- authorized dealers or service partners from the Genesis distribution network, for the execution of a contract or due to legitimate interests. We may also obtain personal data from such parties for this purpose;
- delivery services and parties that send messages on our behalf;
- parties assisting Genesis in its services and who are not processors (e.g., accountants and (legal) advisors), due to our legitimate interests;
- (potential) buyers or investors, due to legitimate business economic purposes (such as the (possible) sale of business activities or shares or a reorganization);
- authorities enforcing the law, including investigative agencies, or other third parties, if we are legally required to do so;
- leasing companies, due to an agreement you are party to. We may also obtain personal data from such parties for this purpose;
- financial service providers due to an agreement you are party to. We may also obtain personal data from such parties for this purpose.
The transfer of your data to the above third parties will only take place insofar as permitted under applicable laws and regulations. Some third parties engaged by Genesis qualify as 'processors' (e.g., hosting service providers, certain software suppliers, mobility service providers, or parties organizing or conducting promotions or research). Agreements with such parties are made in accordance with applicable legal requirements.
Cookies
We may use cookies and similar technologies to store and read information on devices you use (such as a computer or mobile phone) to remember your website preferences, provide a better online experience, and/or personalize advertisements from third parties. We may also combine data obtained through cookies with other data about you to create a customer profile of you, as far as relevant to our offerings. We only do this with your consent, as explained below.
Profiling and Direct Marketing
If you have given consent to receive marketing communications from us (if this consent is required), we may use your personal data to personalize this communication based on your preferences and customer history (see also the explanation in the next paragraph). No special categories of personal data are used for this purpose. This way, we can send you relevant and personalized communication about Genesis products and services, offers, and events, or invite you to participate in market research and surveys. This can be done via all channels through which we send direct marketing, such as email, post, phone, or messaging services, depending on your preferences.
When you consent to receive marketing communication, we only send marketing communications for which you have registered. If you no longer wish to receive marketing communication from us, you can change your preferences or withdraw your given consent. You can do this by clicking 'unsubscribe' in any message you receive from us.
To send you personalized communication, we create an individual customer profile of you. We may use certain procedures to analyze your preferences, interests, and use of our products and services. You can read more about this under 'Data analysis and segmentation to promote and personalize our marketing activities.'
Data Analysis and Segmentation to Promote and Personalize Our Marketing Activities
To optimize our marketing activities and personalize our communication, we may use procedures and systems for data analysis and data segmentation. We create a customer profile of you as a basis for our marketing activities. We mainly do this to measure and understand the effectiveness of our advertisements and communication, but also to send you relevant communication about our products and services tailored to your wishes. As a result, you may receive certain communications and not others, unlike other customers.
To create a customer profile of you, we combine your preferences and interests with information about your use of our products and services, such as (i) your service history and interaction with our authorized dealers and service partners, (ii) your interaction with online marketing and CRM campaigns, (iii) your online behavior and the websites and apps you visit or use, and (iv) your vehicle data.
Once we have a complete customer profile, we will use this profile for predictive scoring. This means we use data, algorithms, and machine learning techniques to assign scores to different segments based on your data. Through these segments, we can distinguish the key characteristics and behaviors that determine our marketing activities. When your customer profile is assigned to specific customer segments, we can determine the type of marketing activity, its content, and the amount to ensure that you only receive communication relevant to you.
Transfer Outside the EEA
To provide our services, we may need to share your Vehicle Identification Number (VIN) with Hyundai Motor Company in South Korea. We only do this in the case of a warranty claim on a car, for statistical purposes, and to determine whether a recall needs to take place. When this happens, we take all necessary measures such as entering into a model contract or contracting with parties subject to an approved certification mechanism to lawfully transfer personal data to such countries. Your Rights, Including the Right to Object
You have the right to know which personal data we hold about you and for what purposes, and the right to access and correct this data where necessary. If you have given consent, you may withdraw it at any time, upon which the relevant processing will cease. You also have, in certain cases, the right to object to processing related to direct marketing and processing based on the 'legitimate interest' ground, and to request us to restrict, delete, or transfer your personal data (data portability). You also have the right to file a complaint with the Data Protection Authority. You can only exercise these rights to the extent granted by applicable law.

Security
We have taken appropriate technical and organizational measures to secure your personal data against unauthorized or unlawful processing and against loss, destruction, damage, alteration, or disclosure. Retention Period
We generally do not keep your personal data longer than necessary for the purposes for which it was collected and to comply with our legal obligations. This generally means that your personal data is retained as long as one of the following situations applies:
- your personal data is needed to provide you with services or products;
- your personal data is needed to protect and defend our rights and property (usually for the duration of the applicable statutory limitation period); or
- we are legally required to retain your personal data, such as due to tax laws.
Changes to This Privacy Statement
We reserve the right to unilaterally change or supplement this privacy statement. We announce such changes in accordance with the law. When significant changes occur in this privacy statement, clear notification will follow, for example via an email notification.
