PRIVACY NOTICE

GENESIS CANADA PRIVACY NOTICE

Genesis Motors Canada, a division of Hyundai Auto Canada Corp. (“Genesis” or “we”) values your privacy and aims to protect your personal information. This notice explains why we collect your information, how we use it, and how we keep it safe. Please read it carefully. If you disagree with any part, do not provide us with your personal information or use our services or products that collect or use your personal information.

By using the Genesis Website (genesis.com/ca and related websites that Genesis owns, operates, or controls, together, “Genesis Website”), you accept our practices as described here.

We may update this Privacy Notice from time to time. Any changes will be posted on our website, and the effective date will be updated accordingly. We encourage you to review this Privacy Notice periodically to stay informed about how we are protecting your information.


1. Collecting Personal Information

We collect personal information that is necessary for the purposes listed below. This information may come directly from you, our service providers, or dealers. When you interact with the Genesis Website or other digital features, we may automatically gather data about you.


Types of personal information collected

Personal information that we collect may include:


    ·         Information you provide:

·               Contact details: Full name, email address, phone number, and mailing address.

·               Demographics: Household status and purchase preferences.

·               Account information: Usernames and passwords.

·               Order details: Information related to your purchases of vehicles, parts, accessories, or other products and services.

·               Financial information: Details shared by third-party financial service providers or dealers with your consent, including account status, financed amount, monthly payments, total balance, and maturity date. 

·               Purchase or lease information: When you buy or lease a vehicle, distributors may collect information about you that includes your contact information, information included in any application for credit (including financial information, and information about your assets and liabilities) that will be shared with Genesis and, in the case of a pre-ordered vehicle, a copy of your government-issued ID.

·               Call Center interactions: Information from your communications with our call center, including call recordings for quality assurance.

·               Feedback and inquiries: Details you provide when contacting us, giving feedback, or making complaints or inquiries. 

·               Employment applications: If you apply for a job with us, we may collect your education and employment history, information relating to your qualifications, and results of any criminal record or background checks.

    ·       Electronic Event Data Recorders (EDRs): Your vehicle may have an EDR that records information about the vehicle and its occupants before and during certain events, like collisions. This data helps understand how events occur and may include details such as vehicle speed, seat belt usage, and airbag deployment. While EDRs don't record personal information like names or ages, the data could be combined with personal information during investigations by law enforcement, insurance companies, Genesis, regulators, government officials, or other interested parties. Reading EDR data requires special equipment and access to the EDR.  


The collection of your personal information may be subject to any other terms provided to you at the time of any transaction.


2. USING PERSONAL INFORMATION


We use your personal information to provide services you request, for other purposes you have agreed to, and as allowed by law. This includes:


·                Website interaction: When you visit the Genesis Website, we may collect technical information to help us improve website functionality and security, understand the behavior of visitors to our website (website analytics), and improve user experience. This involves processing personal information such as the following: information you submit voluntarily, device IP address, access times, browser type and settings, internet service provider, and information related to your operating system, and may involve the use of third-party analytics service providers.

·               Providing services: We use personal information to keep client databases, process transactions, fulfill orders, provide services related to vehicle warranties, maintenance, and parts, and provide customer support.

·                Communication: We use personal information to communicate with you, including to send you information about products, services, promotions, and updates, and to respond to your inquiries and let you know of product recalls or similar customer notifications.

·                Business operations: We use personal information to conduct market research, and to analyze and improve our operations.

·               Compliance: We use personal information to comply with our legal and regulatory obligations, and as otherwise allowed or required by law.

Cookies

Genesis uses cookies and other tracking technologies, such as pixels and beacons (together “Web-Based Tools"), on the Genesis Website. These tools are used to personalize your experience. 

·                Essential Web-Based Tools: These are necessary for certain features of the Genesis Website. Essential Web-Based Tools help keep the Genesis Website secure, including by detecting and preventing fraud, and help us understand how you use the Genesis Website. You cannot opt-out of the use of essential Web-Based Tools, but you can disable cookies in your browser. If you do this, parts of the Genesis Website may not work properly.

·               Non-Essential Web-Based Tools: These Web-Based Tools help enhance your experience with personalized content, like remembering your language preference or showing relevant offers. We may also use these tools for online advertising, such as showing ads based on your interests. You can opt-out of targeted advertising by visiting the Network Advertising Initiative or the Digital Advertising Association of Canada websites.

Third party websites

The Genesis Website may link to other websites not owned or operated by Genesis. This Privacy Notice only applies to how we collect and use your information on our site. We are not responsible for the privacy practices of third-party websites. We encourage you to review their privacy policies before sharing your personal information.


3. Sharing Personal Information


We may share your personal information with our dealers, affiliates, parent company and service providers for the purposes listed in this Privacy Notice. Genesis has agreements with its service providers to ensure they only use your personal information as needed to provide services to us or to you.


Genesis may share your personal information with our service providers for the following purposes:


Some of our service providers may be outside of Canada or Quebec. In that case, personal information will be subject to the laws of their jurisdiction, which may differ from the those in Canada and Quebec. In that event, and subject to the laws in place in those jurisdictions, we ensure that protections are in place to maintain equivalent data protection standards.

We may also disclose your personal information to protect the rights, property and interests of Genesis including intellectual property rights, to manage, defend or settle any actual or potential loss, and as otherwise allowed or required by law, such as to respond to court orders and subpoenas, prevent fraud, and investigate suspicious activity.

Third-Party products and services

We may facilitate your use of third-party products and services, like connecting your mobile phone with your vehicle. For example, services such as Android Auto™ or Apple® CarPlay may require us to share your personal information with these third parties.

Genesis does not control these third-party products and services, and we are not responsible for their privacy practices or terms. Before using these services, we recommend reading the third parties’ privacy policies and terms of use.

SiriusXM subscription

If you buy or lease a Genesis vehicle with a trial subscription to SiriusXM satellite radio, we or the dealer may share your personal information with SiriusXM Canada Inc. and its affiliates (together, the "Sirius XM Entities"). This includes your name, address, phone number, email, vehicle model, and the serial number of your vehicle’s SiriusXM receiver. We share this information to activate your trial subscription, allow SiriusXM to offer additional products or services, and send marketing materials (e.g. renewal offers) by email. We may also share data about the performance or usage of SiriusXM in your vehicle with SiriusXM to improve products and services.

4. PROTECTING PERSONAL INFORMATION

We implement policies and procedures to protect your personal information. For example, Genesis has measures to:

·      Prevent unauthorized access, use and disclosure of personal information.

·      Define roles and responsibilities for handling personal information.

·      Respond to questions, complaints, or privacy breaches.

·      Limit the use of personal information to the purposes described in this Privacy Notice.

·      Respect individuals’ choices about their personal information.

·      Ensure personal information is not kept for longer than is necessary.

·      Securely destroy or anonymize personal information once we no longer need it.

·     Ensure our service providers protect the personal information they handle on our behalf.

We regularly review these practices to make sure they are effective and appropriate.


5. RETAINING PERSONAL INFORMATION

We only keep personal information for the time needed to fulfill the purposes described in this Privacy Notice, or as necessary to comply with legal or regulatory requirements.



6. Your Rights

You have the following rights regarding your personal information:

·               Right of access: You can request information about how we process your personal information and may request a copy of it.

·               Right of correction: You can ask that we correct inaccurate or incomplete personal information.

·               Right to withdraw consent: If you previously gave us consent to collect, use or disclosure your personal information, you can withdraw that consent, subject to legal requirements. Doing so may affect your ability to access or use the services affected by the withdrawal. You may also opt-out of promotional emails by clicking the “unsubscribe” button.

·               Right to erasure (for Quebec residents): Under certain circumstances, you can ask that we delete your personal information.

·               Right to be forgotten (for Quebec residents): Under certain circumstances, you can ask that we stop sharing your personal information or remove links to your personal information.

Please contact our Privacy Officer at privacy@genesis.ca to exercise any of these rights or if you have any questions about your rights. We may verify your identity before responding to your request.


7. updating personal information

We aim to ensure your information is accurate, but it is important that you notify us if anything changes. You can update your personal information by calling 1.888.999.9895 or selecting “Communication Preferences” at the bottom of this page. In some cases, we may ask you to submit your request in writing.


8. CHILDREN'S PRIVACY

We do not knowingly collect personal information from individuals under 14 years old without verifiable parental/guardian consent. If you believe your child has provided their personal information without your consent, please contact us at privacy@genesis.ca to have this information deleted.
